Daniel Del Monico v. Arthur Rodgers Traynor SC10-1397
Mr. DelMonico sued Mr. Traynor, an attorney representing a defendant in an underlying lawsuit filed by Mr. DelMonico. The lawsuit against Mr. Traynor and his law firm alleged that Mr. Traynor defamed Mr. DelMonico while speaking with third parties about the underlying lawsuit. Mr. Traynor argued that the communications were absolutely privileged because they occurred during the course of a judicial proceeding. The trial court agreed and granted summary judgment. The Fourth District Court of Appeal upheld that ruling.
