State of Florida v. Kevin Kinder

On Sept. 3, 1999, the State petitioned for the involuntary civil commitment
of Kinder on grounds he was a sexually violent predator under the Jimmy Ryce
Act. A hearing was set for Sept. 21, 1999, but it was canceled due to an approaching
hurricane. Apparently through oversight, the hearing was not rescheduled until
Oct. 18, 1999. Kinder argued he must be released from custody for failure to
bring him to trial within the 30 days required by statute. The trial judge ruled
for the State, but the Second District Court reversed.
