Travis Tanguay v. State of Florida
no.01-613
Polk County
Tanguay was sentenced as a juvenile to a period of detention not to exceed
his 19th birthday. He was held beyond that date to be evaluated under the Jimmy
Ryce Act, and the State later filed a civil commitment petition against him. He
moved to dismiss on grounds that the State lost jurisdiction because he was held
for evaluation after his lawful sentence had expired. The trial court dismissed
the motion, but the Second District Court reversed in part and certified the question
to the Supreme Court.
