The Ackers divorced after 23 years of marriage. At the time of their divorce
in 1993, they entered into an agreement equitably dividing their assets at the
time. Under this plan, the husband kept all his interest in a company pension
plan then estimated to be worth $487,000, but agreed to pay his wife $3,000 in
alimony subject to review at his retirement. Some years later his company offered
an early retirement option that allowed the husband to retire and receive a lump-sum
payment of more than $1 million plus a monthly pension of $7,803. Both parties
sought to modify the divorce judgment, but the trial court denied the claims.
The Third District affirmed.
