Style: Puccio v. State, No. 86,242
Facts: Puccio was convicted of first-degree murder and was sentenced to death. Onappeal he argues that he should not have been sentenced to death when others who tookpart in the murder received less severe sentences; that the court allowed improperevidence to be admitted and erroneously excluded other evidence; that the court gaveerroneous instructions to the jury and refused defendant's requested instructions; thatimproper argument was allowed; that the sentencing findings were erroneous; that thetrial judge considered and weighed the evidence improperly; and that death is not theappropriate punishment for the crime.
Issues: (1) Whether the conviction should be reversed.
(2) Whether the death sentence should be reversed.
