Facts: The parties divorced after 33 years of marriage. The former husband has a vestedinterest in his employer's retirement plan and will be eligible for benefits upon retirement.The trial court awarded the former wife a deferred interest in the former husband'spension benefits, including that portion of his future benefits that will accrue to him basedon his earnings after the dissolution of marriage. On appeal, the district court reversed,holding that the former wife was not entitled to benefit from the accrual of future benefitsto the pension plan. The former wife seeks review.
Issue: Whether upon dissolution a former spouse is entitled to a deferred interest in the
portion of the former marital partner's pension benefits accruing after the dissolution of
the marriage.
