Merck was convicted and sentenced to death for the October 1991 murder of James Newton. Due to errors in his sentencing proceeding, his case was sent back for reconsideration before a jury. Based on a 12-to-0 recommendation, the trial judge again sentenced Merck to death in 1997. Merck appeals.
