Facts
In 1994 Warren sued Shands for malpractice. Her attorney served the legal papers 121 days later, one day after the 120-day period required by rules of court and the trial judge's order. The judge ultimately dismissed the suit because of the late service of papers. On appeal, the First District Court reversed on grounds the trial judge used the wrong standard in deciding to dismiss the case. This appeal ensued.
