Facts
Pinellas County proposed a bond issue to fund
development of a system for using reclaimed
water for irrigation and other industrial
use. The County contended this would reduce
the need to use potable water for nonpotable
uses while providing an alternative to
disposing of waste water through deep-well
injection. The trial court refused to
validate the bonds on grounds the County
needed, but had not obtained, the consent of
the municipalities affected and that charges
associated with the use of reclaimed water
would be an unauthorized tax. The County
appeals.
