CITING THE POLICY'S CONCERNS, THE TRIAL COURT, AFTER AN EVIDENTIARY HEARING, EXCLUDED, RULED THAT THE BLOOD ALCOHOL LEVEL, AS WELL AS A PERMISSIVE INFERENCE UNDER THE IMPLIED CONSENT STATUTE, WOULD BE EXCLUDED. THE STATE TOOK THE CASE TO THE FIRST DISTRICT COURT OF APPEAL. THE FIRST DISTRICT COURT OF APPEAL, CITING THE TRIAL COURT'S REASONING, AFFIRMED THE TRIAL COURT, BUT IN ADDITION TO THAT, CERTIFIED A QUESTION WHETHER THE PERMISSIVE INFERENCE WOULD APPLY IN THIS PARTICULAR CASE, IN THIS PARTICULAR SITUATION, WHERE THE STATE MEETS MEETS THE THREE ---MEETS THE THREE-PRONG TEST OF BENDER ROBINSON, AND WE SUBMIT THAT THAT IS HOW WE ENDED UP HERE BEFORE THE COURT. AT THE EVIDENTIARY HEARING, IN FACT, DEFENSE COUNSEL DID OB, WHEN THE STATE STARTED TO GET INTO THE PARTICULARS OF THIS PARTICULAR BLOOD.
