Summary:

After buying a new automobile from Hialeah Automotive, Mr. Basulto and his wife accused the company of engaging in deceptive and unfair trade practices. The company moved to dismiss their lawsuit and compel the couple to enter into arbitration, citing provisions in the contract. But the trial court ruled there was no valid arbitration agreement to enforce. Hialeah Automotive appealed to the Third District Court of Appeal, which affirmed in part and reversed in part. This discretionary review followed.
