Mr. Whitton was convicted of the first-degree murder of James Mauldin, who was fatally beaten and stabbed in 1990. The jury voted unanimously to recommend a death sentence and the trial court condemned Mr. Whitton. This Court upheld the death sentence on direct appeal and Mr. Whitton filed a post-conviction challenge in trial court. It was denied and this appeal followed. Walton County
