Debary Real Estate challenged a state law that lets a pari-mutuel permit-holderchange the class of the permit from jai-alai to greyhound racing under certainconditions. License Acquisitions, a defendant, asked the trial court for asummary judgment against Debary's allegation that the law was enacted inviolation of the Florida Constitution. The trial court issued the summaryjudgment sought by License Acquisitions. But the First District Court of Appeal overturned that decision, finding the law was unconstitutional.
