Summary:

During an ongoing narcotics investigation, police stopped Ms. Hinman for a traffic violation. After questioning her about the presence of weapons or drugs in her car, they arrested her on charges of drug trafficking. She argued her comments and the evidence seized by police could not be used at trial because she was not advised of her rights. The trial court agreed. But the Third District Court of Appeal reversed the trial court, ruling the police were not required to read Ms. Hinman her rights because she was not in custody at the time.
