Statewide Impact
The Supreme Court’s Capital Postconviction Proceedings Subcommittee has proposed
a number of revisions to court rules that affect postconviction cases filed by death row
inmates in trial courts. Some examples of the proposals submitted for this Court’s
consideration: a new deadline of 180 days to file claims based on new evidence;
specific direction that circuit chief judges begin monitoring capital postconviction cases
as soon as the direct appeal is finished; a new requirement that all expert witnesses
who testify must file written reports.
