Mr. Hernandez-Alberto, a Mexican national, was convicted of the first-degree murders of his stepdaughters Donna Berezovsky and Isela Gonzales, who were fatally shot in 1999. The jury voted 10-2 to recommend a death sentence for each murder. The trial court condemned Mr. Hernandez-Alberto. This Court upheld his conviction and death sentence on direct appeal. Mr. Hernandez-Alberto filed a postconviction challenge in the trial court. His motion as dismissed and this appeal followed.
