After Ms. Curran was hurt in a traffic accident, she sued State Farm seeking payment of the policy limits under her uninsured motorist insurance policy with State Farm. State Farm argued Ms. Curran forfeited coverage under the policy because she failed to comply with the policy requirement that she be examined by a physician chosen by State Farm prior to initiating litigation. The trial court disagreed with State Farm's argument and awarded Ms. Curran $100,000 and State Farm appealed. The Fifth District Court of Appeal ultimately held for Ms. Curran.
