Mr. Van and his wife sued Mr. Schmidt after an auto collision, which they alleged injured Mr. Van. At trial, Mr. Schmidt argued that Mr. Van's injuries were not caused by the collision. The jury agreed with Mr. Schmidt. The judge granted the Vans' motion for a new trial, agreeing the jury verdict was contrary to most of the evidence. On appeal, the First District Court of Appeal overturned that decision, finding the trial court abused its discretion. The Vans asked this Court to review the case.
